warranty
optibase ltd. (hereinafter “optibase”) warrants, for your benefit only, that for a period of 12 (twelve) months from the date of purchase (as defined below) of the hardware product (the “product”), the product shall be free of defects in materials and workmanship.
“date of purchase” shall mean the date of your receipt or invoice.
optibase shall bear no responsibility for correcting, curing or otherwise remedying any nonconformity or defect in the product (or any other breach with respect to the condition or operation of the product) if (1) the product is not properly installed; (2) the product is not maintained and operated according to the conditions of the installation guide by qualified personnel; (3) the product incorporates spare or replacement parts other than those purchased from optibase; (4) the product has been subject to any abnormal electrical, mechanical or environmental abuse or misuse or taken apart, including but not limited to reformating of the hard disk included in the product; (5) software or hardware other than those purchased from optibase, including but not limited to the operating system installed on the product.
optibase’s sole responsibility in the event of any material defect in the product, shall be to repair or, at optibase’s option, replace the product, and the foregoing shall constitute your exclusive remedy. you will bear all cost of shipping and handling the product to optibase’s offices.
any claim based on the foregoing warranty must be reported to the customer service department of optibase for a return materials authorization (“rma”) number.
except as expressly set forth herein, optibase makes no warranty or representation, express or implied, as to any matter whatsoever. optibase specifically disclaims, without limitation, any implied warranty of merchantability or fitness for a particular purpose.
in no event shall optibase be liable for any indirect, exemplary, incidental, or consequential damages arising out of or otherwise relating to the use or performance of the product.
in order to assure coverage under this warranty you must fax or mail this warranty card and the sales receipt to optibase within 30 days of the date of purchase.
